Motorcyclist ‘Raped’ By HIV Ladies. YEeee!!

There is a case of two ladies who boarded a commercial motorbike and when they got to a lonely spot they forced the bike to stop and forced the rider to have sex with them in-turn at gun point. They were aware that they were HIV positive, how will the case  be treated if they are apprehended?

It has been said on few occasions in this column that the law as it is on rape at present only contemplates that it is a male that is capable of committing the act against a female.
The scenario that you described, either real or imagined, has ingredients of rape in the eye of a right thinking ordinary person. But in the eye of the law it is unfortunately not so, at least for now. Sometimes, the law is as it is and not the way it ought to be. That is why it is necessary to review some of our laws to reflect present challenges.
Those who drafted both the criminal and penal code probably did not anticipate that a time would come when females would sexually assault males physically. Curiously, one would have expected that the recent review of Lagos State Criminal Code would contemplate this and reflect it accordingly.  But this is not too late as law review is a continuous exercise.
Back to the instant case, there are elements of other criminal offences in the incident. If the run-away HIV positive ladies are apprehended by the police, they are likely to face prosecution for being in possession of arms unlawfully since you said the motorcyclist was stopped at point.
Also, they are likely to be charged with indecent sexual assault similarly, they may equally to be charged with attempted murder since there was an obvious threat to life of their victim.
However, there is no law at the moment criminalizing willful spread of HIV by infected persons.
For the umpteenth time, will repeat the provisions of the criminal code and penal code on rape.
According to Section 282[1] of the Penal Code: “A man is said to commit rape when he has intercourse with a woman in any of the following circumstances: a, against her will; b, without her consent; c, with her consent, when her consent has been obtained by putting her in fear of death or of hurt; d, with her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married; e, with or without her consent, when she is under fourteen years of age or of unsound mind.”
Similarly, Section 357 of the Criminal code, Laws of the Federation: defines rape as: “Any person who has unlawful canal knowledge of a woman or girl without her consent or with her consent, if the consent is obtained by force or by means of threat or intimidation of any kind, or by fear of harm, or by means of false or fraudulent representation as to the nature of the act, or, in the case of married woman impersonating her husband is guilty of an offence which is called rape.

Franziska, 33 from Germany, who weighs nine stone is accused of ‘attempted manslaughter with a weapon’ after her 13-stone boyfriend claimed she tried to smother him with her breasts and pretend it was a s*x game.

Mr Schmidt said when they met four years ago, the couple had been completely in love.
He said: ‘Everything was great between us – and I would have done everything for her. But it started to go wrong when I got my first job as a lawyer and we moved to Unna.
‘She could not hold down a job and just had one part-time job after the other. And the better my career went – the worst it seemed to be for her.’
He said Franziska tried to kill him after learning he was planning to leave her.
‘It is clear she wanted to kill me,’ he said. ‘She even admitted it to me on the telephone. I asked her why she wanted to smother me to death with her breasts and she told me: “Treasure – I wanted your death to be as pleasurable as possible.”

Ex-banker Embarked on Hunger Strike and Sleeps on The Street in Lagos

Olubiyi Odunaro, a 53-year-old former employee of Hallmark Bank Plc., has embarked on hunger strike to protest against non-payment of his terminal benefit.

Besides, the ex-banker has turned a garden on Mobolaji Bank-Anthony Way into his new home, vowing to remain there until he is paid his benefits.

Hallmark Bank was one of the banks which did not meet the Central Bank of Nigeria’s recapilatisation policy in 2005 resulting in its folding up.

Odunaro, a senior manager of the defunct bank, said he began the hunger strike on November 12.
When our correspondent visited him on Mobolaji Bank Anthony Way, opposite Opebi U Turn Road junction, on Tuesday, he was seen reading a novel ‘Long walk to freedom’ by Nelson Mandela.

He explained that he embarked on the protest to expose the insensitivity of the Federal Government to pay the terminal entitlements of over 14,000 employees of the 14 banks that failed to meet up with the recapitalisation policy.

Odunaro said he wrote President Goodluck Jonathan on October 24 informing him of his decision to embark on the hunger strike if the agencies concerned did not pay them their entitlements on or before October 31.

He said, “I feel downcast with the turn of events in our country and I drew the passion to embark on a hunger strike from my disenchantment to the deliberate denial of common citizens’ rights.

“Before, I began this hunger strike, I sought the consent of my family members and I also underwent a comprehensive medical examination. I erected that tent with N27,000 and it is now my new home.”
Asked if his health has not been deteriorating, Odunaro said, “Though I take water at 8pm everyday, It’s gradually taking a toll on me as I have started losing weight.

“My personal doctor came to examine me on Friday and he said I am not doing bad health wise. There have been pleas from friends and other loved ones to end this strike. But, I will continue with the hunger strike until the FG pays us our lawful entitlements.”

He lamented that despite the laid down procedures contained in the Guidelines and Incentives on Consolidation in the Nigerian Banking Industry, they had not been attended to.

He said, “It wasn’t our wish or our making to be out of jobs. The CBN in its own wisdom introduced the recapitalisation policy and afterwards withdrew the operating licence of Hallmark Bank where I worked and 13 other banks for failing to meet up with the recapitalisation policy deadline.

“But, seven years on, the guidelines on consolidation which make provision for our compensation in view of the development had not been followed.”

He said despite writing several letters of appeal as a group to the FG and other relevant agencies concerning the issue, they had been ignored.

He said, “On a personal note, I even took it upon myself to get President Goodluck Jonathan informed by posting series of comments about this issue on his Facebook page.

“Unfortunately, nothing has been done and many of us live a deplorable way of life with the majority unable to meet obligations to their children and other dependants.

“Thirty-eight people from just three banks that I know of have died and one of the employees of Hallmark Bank committed suicide in Aba, Abia State, as a result of his inability to eke out a living.”

Man Returns From Night Vigil At 3am, Catches Wife In Bed With Neighbour

A man who had gone for an all-night prayer got the shock of his life when he allegedly caught his wife pants down with a neighbour at their matrimonial home.
The incident which occurred in Zimbabwe is said to have happened at around 3am. A source said the husband, only identified as Maskiri, returned home from prayers and caught his wife Fungai Sibanda having sex with their neighbour Tinashe Mutuwari. It is alleged that the woman had invited the man to sleep over at her place after claiming to be lonely.
“The two lovebirds’ timing was wrong as Maskiri decided to return earlier than expected and he caught them in the act. He then alerted some neighbours who proceeded to report the matter to the police,” said a witness.
When Maskiri was contacted for comment, he opened up saying he was still in dilemma of what had driven his wife to do such an embarrassing thing.
“I had gone for an all-night prayer and my wife had remained at home. At around 3am, I decided to go home as I was feeling sleepy. When I got home, I got the shock of my life as I found my wife sleeping with Tinashe on our bed. I became weak and could not do or say anything to the two. I quietly walked out and informed some neighbours as I proceeded to report the matter to the police,” said Maskiri.
He revealed that he suspected it was not the first time Tinashe had spend the night at his home as he regularly went for all-night prayers leaving his wife at home.
“Surprisingly, Fungai rushed to seek a peace order against me saying I was troubling her and she won the case,” he said.
Tinashe could neither confirm nor deny the allegations.
“The matter is being handled by police and Maskiri keeps on accusing me of sleeping with his wife,” said Tinashe.
Efforts to get a comment from the woman at the centre of controversy were fruitless as her phone was unreachable.

Couple Fined, Jailed For Making Out In A Tax


An Irishman and a British woman were sentenced to three months in jail each for public nudity and getting s*xually intimate in a taxi’s backseat while they were heavily drunk.
The Dubai Misdemeanour Court convicted the 27-year-old Irishman and the 29-year-old British woman of consuming liquor, getting naked in public and indulging in a s*xually intimate situation.
Prosecutors accused the couple of public indecency, having consensual s*x and consuming liquor.
Dubai Police’s forensic examiner confirmed that the woman did not have s*xual intercourse soon before the incident in May.
According to the primary verdict, the court found the defendants guilty of removing their clothes in the back seat of the taxi, where they indulged in a form of s*xual activity.
“The taxi moved around in public streets. The woman removed her clothes and sat face-to-face on the man’s lap. Meanwhile the latter removed his pants and opened his shirt then they hugged before the eyes of the taxi driver. A police corporal also saw them involved,” read the verdict sheet.
The convicts pleaded not guilty when they appeared in court. They denied cuddling, fondling and having s*x in the taxi on Shaikh Zayed Road.
Meanwhile, their lawyer Shaker Al Shummari accused the Pakistani driver of fabricating the allegations.
“The 27-year-old indulged in a heated argument with the driver, who apparently took a longer route wanting to get extra commission over the fare. When the Irishman told the driver that he would report him to the police, the driver stopped near a police car and claimed that the couple undressed and had s*x,” argued advocate Al Shummari.
According to Thursday’s judgment, the couple were fined Dh3,000 (N128,644) each after they confessed to drinking. The defendants will also be deported after serving their sentences.
Prosecution records said when the driver spotted the couple making out, he pulled over in front of a police car and honked.
An Emirati police corporal claimed that he spotted the woman naked and sitting on the lap of her partner, who had his jeans pulled down.
The policeman claimed the couple was involved in a form of indecent movement that made him think they were having s*x.
“The defendants are residents of Dubai and they know its streets well. The Irishman had a heated argument with the driver when he took a longer route. The malicious driver fabricated this unrealistic and illogical story because my client said he would report him to the police. The driver and the policeman gave inconsistent statements… meanwhile the fact that the couple gave similar statements has come to firmly refute the driver’s allegations,” advocate Al Shummari said in court.
The policeman testified that it was 10.30pm when the taxi pulled over in front of his patrol and pointed at the couple in the backseat.
Thursday’s judgment remains subject to appeal within 15 days. [GN]

Aliko Dangote of Nigeria tops the list for the second year running, with a net worth of $12 billion, up from $10.1 billion in November 2011. Most of his net worth lies in publicly traded Dangote Cement, which operates in 14 African countries.
Nicky Oppenheimer of South Africa comes in once again as the second richest, with a $6.4 billion fortune—down $100 million from a year ago. Oppenheimer decided in late 2011 to sell his family’s 40% stake in diamond producer DeBeers to mining company Anglo American for $5.1 billion. The deal got final regulatory approval in July 2012, marking the end of 85 years of Oppenheimer family control of DeBeers.

RIP!:3 Crushed To Death In Lagos As Container Falls


Three persons were yesterday crushed to death when a 40-feet containerized vehicle fell on a Mazda car on the Badagry-Seme Expressway.
The accident which occurred at about 1.15 p.m., was attributed to the bad road which has been a nightmare to commuters and other users of the road.
The containerized vehicle with registration number XT 339 AKD was said to be conveying some goods when it lost control and fell on the car, with four occupants. Three of the passengers died instantly, while the driver was in a critical condition.
The accident caused a heavy traffic while passers-by went on an immediate rescue mission of the trapped persons, before officials of Federal Road Safety Corps, FRSC, and Lagos State Traffic Management Authority, LASTMA, came to the scene of the accident.
Three of the passengers pulled out from the crushed car had already died. The driver of the truck, reports say fled immediately the accident occurred.
According to eyewitnesses, the bad portion of the road has been left because of the on-going reconstruction and that the danger has been there all along.
“For the fact that the road is no longer manageable, road users often drive against traffic to avoid container carrying trucks; now it has claimed lives,” exclaimed a regular road user.
The accident attracted a lot of condemnations of the government towards its people, with an eye-witness saying; “This is an indication that we are all driving on a time bomb. It could be I or you tomorrow”
As at the time LASTMA officials arrived the scene of the accident with a towing van in order to lift the container off the compressed car, a large number good spirited Nigerians, who swung into action almost immediately the accident occurred, had already evacuated the passengers on board the car with registration number UK 641 KJA.

Saudi Arabia Chops Off Nigerian’s Right Hand For Theft(HMM)


Saudi authorities on Wednesday chopped off the hand of a Nigerian man convicted of theft, in compliance with the Islamic sharia law strictly applied in the kingdom, the interior ministry said.
Mohammed Ahmed Ibrahim was convicted of theft and sentenced to having “his right hand amputated” the ministry said in a statement carried by SPA state news agency.
The punishment was executed in the western city of Mecca, home to the Muslim holy Grand Mosque, where the theft took place, it said.
The ultra-conservative kingdom applies the Islamic sharia law, including executions by the sword for people convicted of rape, murder, apostasy, armed robbery and drug trafficking.
Just recently, a Palestinian was beheaded in the kingdom for forming a robbery gang.

Building collapses in Lagos killing two sisters

A building located in Low Cost Housing Estate, otherwise called Jakande estate, in Oke-Ake-Afa, Isolo area of  Lagos, collapsed, yesterday, killing two graduate sisters.

The mother of the dead girls, identified as Mrs Coker, a widow, who was brought out of the debris alive was, however, in coma yesterday. Affected were flats 2, 4 and 6 of the six flat low-cost houses built over 30 years ago.

The building, Block M20, according to eye witnesses started showing cracks and sinking over a year ago. The tragic incident as gathered, occurred at about midnight causing  a deafening sound.



Vanguard gathered that while occupants in flats 2 and 4 managed to escape, those in flat 6 – Mrs Coker and her two children: Toyin, a graduate of the University of Lagos and her younger sister, Bukola, did not.

It was learnt that occupants of the collapsed building apparently ignored the warning signs of imminent danger which was evident since the past year. Tenants in flats two and six reportedly moved out some months ago, only for owner of flat two to lease the flat out to new occupants.

After the incident, youths in the area reportedly began a rescue mission. The body of Mrs Coker in her unconscious state was said to be the first to be brought out from the debris at about 3am and was immediately rushed to the estate health centre. Bukola’s body, in her night gown was reportedly brought out at about 5am, while that of  Toyin was brought out an hour later, stone dead. When Vanguard arrived the scene at about 8am, officials of NEMA and neighbourhood watch were sighted.

Fire fighting vehicles arrived later.
